FMCSA posts HOS questions for discussion

log bookThe Federal Motor Carrier Safety Administration is asking people interested in participating in listening sessions on a future hours-of-service rule to consider questions on its website.

The agency posted five areas of discussion on its website in preparation for the listening sessions, scheduled for Jan. 19 in Arlington, Va., Jan. 22, at the Dallas Forth Worth airport and Jan. 25 in Los Angeles. The FMCSA has not announced a fourth session yet.

The topics are rest and on-duty time, restart to the 60- and 70-hour rule, sleeper berth use, loading and unloading time, and general.

The agency said it presented the questions for discussion. It will not necessarily include them in a Notice of Proposed Rulemaking but would request similar information in that document. Answers should be based upon the experience and information participants can share with the FMCSA.

    Dear Fmsca.when considering changes to Hos rules. I would request a 12 hour maxium workday for drivers,with the 2hrs left on the 14hr rule being the drivers time for lunch breaks and n aps. Keep the 10hr break rule. Have the restart go to 40hrs instead of 34hrs. Change to 9hrs driving from the present 11hrs. Ban driver loading n unloading.no need for drivers to be on the dock.this would create jobs for unemployed. No split breaking!! We work 70hrs a week. We should only drive the truck. No counting freight. That’s the shipper n receiving responsibility. You must create a rule for dispatching loads. 50mph for work assignments over 200 miles. 40mph for assignments under 200 miles. City assignments n multiple stop assignments at 30mph. Require all loading n unloading be done in 2hrs. This would increase productivity and reduce the amount of trucks on the road. The driver has been held hostage by companies for to long. We need fair labor laws to protect the drivers health and keeping the roadways safe!

      If all you are averaging is 50 miles an hour, you need to get a new profession unless you live in Oregon. With the speed limits of most states being 65+ for trucks, there is no reason you can’t average at least 60 miles an hour unless you are just stopping at truck stops and playing video games all the time.

      The way things are now are perfect and the safety records prove that. If you are afraid of working, go to McDonalds. Cutting from 11 to 9 and 40 instead of 34 is you wanting the government to mandate you working less.

    To FMCSA. When looking at HOS changes #1 Get the Labor Dept. to put the trucking industry on the fair labor standards. #2 Make the log book only 2 lines, you are eather on duty or off duty. #3 then go to a flat 12/12, with a provision to be able to split it 6/6 for solo or teams. #4 Make it law the a driver drives, no loading or unloading and no lumpers. The recevers order the product it should be their problem to hire the people to do these jobs. #5 No dispatch for driving over 50 mph, if you are going to preach safty then pratice what you preach, and put some teath in it to make companys complie. #6 Make law a fair wage for our industry that drivers can actullty live on and not have to worry about paying thier bills if they take time off. I make these sugestions for the stand point of being a lone haul driver for the last 30 yrs.

    To FMCSA.There should be stiffer laws protecting the driver.I drive for a training company(Stevens Transport)They like a revolving door.Make room for the inexperienced.I have been getting numerous violations due to them wanting to make room for trainees.I call in and ask if i can take a 34hr reset while under a particular load, permission is granted but when i go into compliance they hand out violations.They will violate your 10 and 14 because you have done something that has taken less than 7 minutes.The only way not to get violations is to lease a truck from them.They let there lease operators drive out of service all the time.But then if you lease a truck from Stevens you have to if you like to eat.And why should we as drivers half to worry about counting the product on docks or even paying a lumper.Shouldnt we be resting during that time.Instead we constantly are disturbed at our recievers.They will keep you there for hours then when your 14 is out will try to make you leave.They want us drivers to comply with there appt time they set but they do not stick to there own schedule.

    The 34 hour restart is a total joke, I am more tired AFTER a restart than I would be if I didn’t have to take the thing. STUPID! I could see maybe a 24 hour restart, but not 34.

    Get rid of the 14 hour rule, it only prevents drivers from taking a nap when they need one. Keep the 10 break, but allow split logging. Teams really took it up the backside with this last rule making. Solo’s would get the advantage of being able to take a nap while loading/unloading and still be able to run.

    I was also glad to see groups like PATT, etc. finally challenged at these listening sessions for where they get some of their data, and the looks on their faces, and responses said it all. Maybe they should just shut up and sit down.

    Shippers and Receivers need to start paying for delays. Period.

    Pay drivers fairly like the rest of the country gets. A driver can run 2400 miles in 40 hours. Then force companies to pay mile and a half pay over 2400 miles. Example you make .38/mile, after 2400 miles you would get .57/mile. Then companies would limit the work of the driver and logbooks and HOS wouldn’t be needed because companies would avoid the premium pay. Keep the accessory pay too :)
    There are too many loopholes now. Any logbook can be fudged. I’m constanly forced to run illegally and do it well. Anyone that hauls meat or produce knows what I’m talking about. They are going to have problems if you put EOBR’s in their trucks. Me personally, I think the auditors are paid off because you can look at the shippers computer and see all the violations. Shippers shouldn’t be allowed to make delivery appts. They don’t know whats going on with the drivers logbook.

    i’m sick and tired of listening the word “safety” when come to driver regulations,when the last thing they care is the driver; if i get paid by the mile, why i am regulated by the hour?, makes no sense: 1.- pay me for the hour and ill drive only 50 super safe miles a day if u pay my 11hrs.2.- how about banned trucks from every highway from 11:00 pm to 7:00 am… of course they care more about companies and profit than safety, so next time just called “profit rules” you guys gona blame all the errors on drivers anyway.

    Cut the 14 hour rule. Keep the 11 driving and the 10 off but cut the 14 hour rule and let us split our bunk time. Also require shippers and receivers to count and load and unload their own freight and not leave it to the drivers to do.

      u can split your sleeper time. and they need to adjust the 14hr rule and make the 34 hr to 24

    This note has to do with HOS I hope during your HOS review you would take into consideration eliminating the 14 hour rule to give us drivers more flexabilty to rest when we need to, and not have to drive when we are tired and forced to sleep when we can’t. thank you for the opertunity for letting me post my coment.

    The transportation industry of goods and services is not an 8 to 4:30 or 9 to 5 industry. It is not a normal industry as most would have us to think. Most aspects of the transporation industry work a 24 hour, 7 day, 365 days a year clock, from trains, planes, ships or trucks.

    Our Transporation Industry has become the MOST REGULATED industry in America. The present rules effecting trucking are good rules as to safely conduct business as a solo or team driver, if the rules would take into consideration: 1) rest breaks and 2) the loading and unloading time spent at shippers and receivers.

    1). Rest Breaks, if needed, shall be provided from one to four hour breaks, and should not take away from the 11 hour driving or 14 hour rule. If a rest break is taken, the eleven hours or fourteen hours shall be extended. Studies have proven, by taking a rest break during the course of a normal day with normal day to day duties increases mental awareness and safety, so why not in the trucking industry? It is easier for a truck to pull into a rest stop than a plane! BUt of course, they have auto pilot to rest on too!

    2). Drivers DO NOT have control of the time the shippers or receivers take to load or unload a trailer. The inefficienty comes when a driver is not able to move, which movement equals production and money and the amount of on duty status a driver has left. Appointments are made by the shippers and receivers, but are not kept except to penalize the driver if not on time. If the driver were compensated for his time waiting to load or unload, shippers and receivers would become more efficent, getting the driver in and out in the shortest time. It should never take over 2 hours to load or unload a scheduled shipment! As it stands, the clock keeps ticking against the driver’s ability to be productive and compensated for his time, while the shipper or receiver ends their eight hour shift and the driver has his day just beginning, to make those miles to delivery.

    reading all of the articles from all kinds of people,polititions,trucking magizine editors,truck drivers,and none of them ever mention the root problems or the real fixes. first rest if we dont have a safe and legal place to take our 10 hr break we will never be safe,the states(goverment)are responsible to provide us with a safe place to rest,after all they wrote the laws that we must follow,they are also the ones that can mandate that we have the way to comply whith these rules,if not that is a catch 22,you must do this but we dont care if you can.the first part of the fix is rest areas must be no more than 30 miles apart with ample room for parking,if ever the rest area is full then it must be enlarged,within a resonable amount of time, this would allow us to utilize our time.we would not have to stop with 4 hours left on our 11 because we know that there is no where that we can legally or safely take our 10 hr break,this would also allow us to better maintain our circadian rhythm (our sleep wake cycle)we would then be more alert and safer.with our ability to utilize our drive time to our fullest(stoping when we feel that we need to rest not stoping while we are still awake and alert then having to get up before our body clock says its time to be up)because there isnt any place to stop where we can safely get to.this would reduce the number of trucks and cost associated with truck transportation due to beter utilazation.shippers/recevers must provide truck parking with security that way we wont be a part of the morning rush hour and we will be in tune with our own internal clock because we dont have to get up before our awake time to make our delivery and fight morning rush hour traffic and we will be safer drivers.shippers/recevers are responcible for counting and loading and sorting/stacking with a limit of 30 minites to load or unload their freight after that we go on the clock at a pay rate that is equal to or greater than what we make driving,this will elimanate fudgeing on our log books to make a living,as we wont be losing any money,we will being paid for our probuctive time.shippers should be responsible for us being legal on our weights,if we cross a state scale and are over weight,the shipper would pay all fines and all costs to make the load legal and pay the driver for his time wasted.apointments should be abolished we should have windows of delivery that the driver tells the recver when they will be there,as long as they are open,that is the time to be unloaded.this would prevent us from screwing up our circadian rhythm by the shipper/receiver,this would solve most of the problems.

    Do away with the 14hr. rule. Let me take a nap when I need one or the choice to stay parked during rush hour thus reducing my truck in the mess and reducing added smog. There are a lot of drivers that would rather nap than suffer thru rush hour madness.Split sleeper time would also allow us to run late night hours when there is less traffic and less parking spots. I get better rest when my truck is parked than any team operation rolling down the road. Safer highways would be easier obtained thru better education of the auto drivers ability to understand how to share the road with trucks.

    1) WHEN WE ARE PICKING UP LD AND SHP OR DEL THEY NEED TO UNLD TRK IN 2 HOURS. SHP AND REC ARE THE ONE MAKING APPT. THEY SHOULD EXPECT US THERE AND BE READY TO TAKE LD. THERE IS NO REASON THEY CANT TAKE THAT LD IN 2 HOURS. IF THEY CANT THEN THEY SHOULD NOT MAKE APPT OR ORDER PRODUCT.
    2) WHEN WE ARIVE AT SHP OR CON OUR 14 HOUR SHOULD STP AND DRIVER NEED TO BE IN THE TRUCK NOT ON THE DOCK. SO THEY CAN REST AND NOT BE WORRIED ABOUT 14 RUN OUT OF HOURS.     Leave it to the Goverment, and it’s employees to screw things up. I do not know of a single profitable Govt. Agency . They make rules just to justify there jobs. and if they do make a good rule it usally has no bite to go along with the bark. I remember the ICC rule that said no driver could be forced or coericed into loading or unloading there truck. and you know what that got us!So go and make as many rules as you need to justify your job, and i’ll just ignore those and try and make a living

    Listen people it isn’t that difficult all of us have different oppinions but the most we have is the same goal in mind making money to support our families. Bottom line is that if you take away the time driving then you take away the amount of money you are able to make. Remember time is money. The more time you have to drive the more money you make. Some of us have good ideas some are just obsurd. If they take away the 34 hr restart then you will be left away from the house unless you are there, for at least 3 days before you are able to get another 70 hrs remember the old rules before the restart? if you don’t want to work thats fine but don’t screw the rest of us that need to work. Remember there is no 2 drivers out here the same what works for you may not be good or right for the other driver. Regardless we have got to stick together if we intend to get anything right out here for us. STICKING TOGETHER IS THE ONLY WAY TO GET WHAT WE DESERVE OUT HERE!!!!!!

    I’m always blown away from what you drivers have to deal with out there! I’m always shocked that i don’t hear more stories about some trucker going postal on someone. Some STRAW at a shipper, receiver, a smart mouthed cocky dispatcher and on and on becoming that last STRAW that BREAKS THE CAMELS BACK an otherwise good intentioned persons back, resulting in another postal type event. With the stress of just the job within itself, not to mention the countless other things you must deal with. Getting literally screwed at every corner.Being taken advantage of, in every area they possibly can conceive of. Greedy individuals that i only wish would have coals heaped upon their heads. where are all the do gooders here? where are the advocates? the one thing you could do is the one thing that will never happen. shut down! i think with all that is currently in place and the added things in csa 2010, i for-see sometime soon, chaos not in the form of more abuse from carriers shippers, receivers dispatcher, but rather i see coming to a paper near you more and more drivers reaching their wits end, and when they have no other roads to travel, when they have screwed every last bit of life out of them, they will reap the just rewards upon the industry in ways , i care not fathom, You truckers are hero’s you deliver life everyday and in every way, and it’s damned time someone with power rise up and make things fair and give truckers the rights they deserve before more than a few blows a cork!, AND PEOPLE GET HURT! It is ashamed a driver can’t give an honest days work and be treated fairly at some of these places or by the U.S. etc…. Thanks you guy’s and gals for making my life easier by such a huge sacrifice.     I feel as though everyone has pretty much the same idea’s on the 14hr ruling 10hr sleeper 11hr drive time and the 34hr restart. I feel as though everything should stay the same except the 14hr should be thrown out the split sleeper need to come back. The drivers on the loading docks to load/unload and to count product we shouldn’t do nor pay for a lumper. Now the other thing is the speed limit: I do not feel it is fair to take these trucks all the way down to 60mphs to drive a most Interstates are at least 70mphs. I feel as though the speed for the trucks should be no more than that 70mphs. We are not all to blame for accidents. FMCSA need to get on these people that is driving these cars, van, pick-up trucks, etc. They causes more accidents than a little stop putting all the blame on the truck drivers and start holding them responsible for there actions. We as truck drivers a held responsible for everyone but if you look at the main peoples that make us have the problems it is the brokers, shippers/receivers with there rules and schedules, brokers from them not knowing the trucking business the goverment with all of these charges, how do you expect for drivers to make any money for a living with all of these expensive charges some drivers trucks are there homes. Get off of our backs and you wonder why some drivers act stupid. Look at what they got to deal with

    ALLTRACTORTRAILERDRIVERS should be paid by the hour!!!!!!!at least 17$ an hour. sleeper time needs to be compensated also.expose revolving door companies like werner and swift etc,. PAY US WHAT ITS WORTH!!!!!!!TREAT US LIKE HUMAM BEINGS!!!!

    well i think that the HOS should pretty much stay as id but we should be able to split the sleeper time and stop the 14 hour clock while we are in the sleeper. most of these people who make these laws up most likely have never been in a truck or been out on the road to see what we contend with. we get a dispatch order to pick up a HOT load so we hurry down to pick it up and when we get there its not ready to go and usually isnt for several hours…and the clock is ticking while we are in the sleeper waiting on this HOT load. we are losing time constantly. why cant these idiots who make these BS laws up go live in a truck for a couple months and see what its like. we are actually forced to run more tired. the old law was great but no they had to screw it up Id actually like to see the old law brought back 10 hr drive and 8 hr sleeper.. but the way it is now is ok too just quit changing it around and getting everyone confused..but wait thats it its the dot,s way of making money keep us confused and they can write tickets and make money off us…ahhhh maybe its a conspircy after all….anything for a few bucks.

    1 problem fixe the time the truck sits in dock loading and unloading give the shipper and reciver 2 hours and after that fine them like the airlines 100.000 dollar per truck
    that get there atiation to move faster
    2 cdl is for driving only not to be a lumper
    or for a driver to pay to unload the trailer
    3 get rid of the computer logs
    4 get a fare wage out there for the drivers
    starting around .50cpm
    5 go back to the 10 hours of driving and
    and 8 hours off and 24 hour reseat
    6 get more safe parking for the trucks
    that need to be built
    the airlines have better regs.
    and the pilots are pay by the hour
    of 8 hours flying on a 16 hour day
    and 37.5 hour work week and 100 hours in
    month 1000 hours in a year

    Take it from a guy who ran cross country for 18 years on the old numbers.I am now on the other side of the glass.

    11 hours driving
    10 hours off in between
    48 hour reset clock.
    do away with the 14 hour rule.

    Having to deal with the 14 hour rule doesn’t allow a drive to rest or sleep to avoid traffic
    in congested areas. Many times tired after a few hours, rested a couple hours and was able to complete the driving.As far as lumping, was and still in the moving business. So get over it, and stay away from fast food.Maybe you can work at Walmart.

    Joseph Pryor had it right: make truck drivers of all types subject to the Fair Labor Standards. Everybody else in the country is, excepting only seasonal agricultural workers. Require drivers to be paid by the hour (including owner operators required to pay themselves by the hour), require at least minimum wage, and time and a half for overtime. Problem solved. Drivers have no motivation to drive at higher than legal speeds if doing so would reduce their paychecks. Companies would not schedule trucks to run unreasonable hours if they had to pay for those hours, and if they were required to pay time and a half for overtime, like every other industry in the United States. The same goes for working on the dock at shippers and receivers: if they were required to pay for the services provided, they would cease the practice, particularly since the hours they use would certainly be overtime hours. I have somewhere in the neighborhood of 4,000,000 miles over the road, including a lot of time as an owner operator, and I can assure any and all that if I were required to FIRST pay myself even minimum wage and straight time as an owner operator I would have never been able to pay my fuel bill or truck payments. Freight rates would have to go up across the board for the industry to survive, and the country can’t survive without the industry. We as drivers are joined only by migrant farm workers as the last workers in the United States subject to sweat-shop piece-work pay. If the Federal authorities were really interested in safety and were not controlled by the fat-cat players in the industry this obvious step would have been taken 40 years ago. CSA 2010 and the HOS “overhauls” which we have seen may be good for Yellow Freight and that ilk, but they are a scourge to those of us who make our livings on the highways and byways of America.

    I like the 11 hr.14 hr. Rule as it is..I remember the old day’s sleeping at the dock.Streching a 10 hr.day into 24.I get more rest now than I ever did..And if you need to take a nap a during your work day,you need to see a sleep specealist…Or go to bed instead of playing games…I know what everybody wants is to make trucking a 40 hr work week…To many children and not enough men out here these day’s…

    I also like the HOS the way they are. I also think we should be paid for wait time. This should not be counted as on duty time. It is working and we are used to it. Lumper fees should be the responsibility of the company. Why should we pay them to unload their product? There should be a set rate for hauling freight. I was actually offered $.89 a mile out of Florida because they claimed to have 1,000 trucks sitting and 39 loads. We should be treated like adults who are capable of making mature decisions instead of children. What I dont understand is why make new laws when you dont enforce the old ones. (i.e.) drug testing.

    I drove a truck for over 22 yrs local for 10yrs on the east coast.I think the hourly is the best way to go .IF DRIVEWRS WOULD STICK TOGETHER WE COULD GET PAYED JUST LIKE THE DAMM AIR LINE PILOTS DO !!. IHAVE SAFTEY AWARDS FROM EVERY PLACE I EVER WORKED.The way this traffic is today drivers could work without worring about paying their bills ,could be home with their families and have vacations time .also think driver should have a break every 4 to 5 hrs that way they would not have to worry that much about leg problems for setting in one place to long would cut down on health and save lives.Also have a speed limit for each state and have lanes just for trucks at least two lanes in every damm state also have one lane for trucks to pass these damm slow trucks that is out there running in the slow in the fast lanes because their trucks want go any faster .make co put the time that the truck leaves thier dock on a seal or ticktet yhat way these damm disbater(dickscratcher)can not lie to other damm disbatchers that way when the drivers get there the other co might not be in such a bad mood.this is also and idea let the drivers pick out which way they want to drive that way everyone might be happy. like i said people do not relize the shit these damm drivers go threw thats probley why there so many divorces in the trucking industy.like i said i drove for 22yrs and i know who it is . and it is a known fact if is ruff out there on that road .if every1 would respect these haevy trucks more that would cut down on every thing thanks this is my comment. i was injudied in a truck wreck at a dock while i was sitting still and have been disabled for 11.5 yrs and it was not my fault .i was sitting at a fright dock with head over the sterring wheel when this on driving want a be driver did not check his doors so when he hit my truck it wrecked my life and still is so a warning for any driver ifyou are ever at a dock please do not go to sleep with your head over the wheel i have had to have 2 back surgeyies and now have 3 rods and 6 screws in my back and are messed up for life so everyone please do not lay your head over the steering wheel . all u drivers please be carful and remember u are all loved thank u ps WE NEED TO GET RID OF THESE DAMM CROOCKED LAWYERS ADVERTISING ON THE DAMM T.V. EVERY DAY THAT IS NOT HELPING OUR HEROS OF THE ROAD ONE DAMM BIT .I HAD 11 YRS OF PERFECT DRIVEING RECORD WHEN MY LIFE GOT RUINED SO EVERY ONE OUT BE CAREFUL THIS FROM THE GA. BOGGIEMAN WE LOVE U ALL AND BE SAFE WE PRAY FOR U ALL EVERY NIGHT CAUSE I KNOW WHAT U ARE GOING THREW WISH I COULD GET BACK OUT THERE MAYBE ONE DAY

    I started driving in 2004 after the HOS were changed the last time. The 11/14/70 works for me and i’m sure that it works for you too. Why do the @#&$* in Washington have to change them again. I am also a member of HIGHWAYWATCH and have never seen them any safer. All they are going to try to do is keep the accident rates up and the drivers like You and I in violation of those hours so they can ring us for the rest of the dimes that we have in our pockets to pay those fines.
