White House clears EOBR rule

A final rule mandating electronic onboard recorders (EOBRs) for carriers that have a history of serious non-compliance with hours-of-service rules could be just days away now that the White House Office of Management and Budget has cleared the measure.
The Federal Motor Carrier Safety Administration is expected soon to publish the rule in the Federal Register. Details of the final rule won’t be public until FMCSA announces it. According to OMB’s website, the White House insisted on at least some changes to the rule that was submitted by the Department of Transportation.
As proposed in January 2007, the regulation also would incorporate new performance standards for EOBRs installed in commercial motor vehicles manufactured two years after the rule’s effective date. On-board HOS recording devices meeting FMCSA´s current requirements and voluntarily installed in vehicles manufactured before that date could continue to be used for the remainder of the service life of those vehicles. FMCSA had proposed to encourage industry-wide use of EOBRs by providing certain relief from audit and recordkeeping practices.
FMCSA completed work on the rule during the Bush administration, but the White House failed to clear it before President Obama was inaugurated. A government-wide review of pending rulemakings delayed the regulation, but DOT sent a final rule to the White House in December.
The EOBR issue isn’t settled once FMCSA publishes this rule, however. The agency has said it will consider further expanding the number of motor carriers required to install EOBRs as part of a rulemaking that also will address supporting documents for HOS compliance. FMCSA says it will consider reducing or eliminating paperwork burdens associated with supporting documents in favor of expanded EOBR use.
According to a monthly DOT report, FMCSA now plans to complete work on the EOBR/supporting documents proposal in July with publication in December. Meanwhile, the American Trucking Associations has sued FMCSA to move forward with a supporting documents rule. One of the major concerns is the agency’s decision in December 2008 to begin using satellite positioning data routinely in audits of driver logs. ATA argues that motor carrier obligations for maintaining supporting documents should be clear and established by regulation.
Regulatory action on EOBRs comes as safety advocates and many in Congress are calling on mandatory EOBRs industry-wide. For example, Rep. James Oberstar, chairman of the House Transportation and Infrastructure Committee, proposed a highway authorization bill last year that would mandate use of EOBRs in all commercial motor vehicles subject to HOS rules.



i am tired of this bull shit.its time for truckers to fight back.the goverment needs to stop giving grant money to these people that hate truckers.white house knows nothing about trucking.they need to look into new bills a little closer before they sign it into law.
The Government and every aspect of Authority are taking more and more of our rights away…The idling is one of them , can they put their Family in a car for a day in the winter with NO HEAT.. Now this crazy point system , that goes back 3 years before its actually even in effect, is another CRAZY idea, now recorders in our OWN trucks… ENOUGH IS ENOUGH ….If every owner operator shut down for 1 week,(and we all can think if our truck broke down we would have no choice) and say NO to all of this, then and only then will they hear us…
no you have it wrong if u stop an park it you will only be giving the bigger company who all ready pay there drivers shit more work. that time has pass. it will never happen.and u can not put all the blam on goverment.so of it we did or self.
The way i look at all this is. If drivers would do the right thing and not try to beat the system and cheat on log book, maintain there equipment, and drive in a safe and responsiable maner then all these laws that are imposed on the trucking industry would not be nessary. The reality to all this is there are always going to be those that will try to skirt around the rules because they feel as if rules do not apply to them.Then there are those that all this is not going to matter to them because they follow the rules to begin with and this will just make it easier for them to comply.As far as owner opperators shutting down for a week goes is, You can’t even get one to shut down a full ten hours so a week is a pipe dream. Then if you could get them to shut down there are so many large companies out there that would be more than happy to cover the load that the o/o’s are not covering. I will agree that some of the people that make our laws need to know more about the trucking industry than just the statistic that are past acrossed there desk.But to say they know nothing about the trucking industry is a pretty lame.I live in the state of Tennessee and have found that any time i need help whith my truck the Tn. Dot has been a wealth of information and help that makes it much eaiser for me to stay with in regulations. Bottom line the laws are made to help keep our highways safe. This i am glad of because even with all the laws that are in place for pro. Drivers and private drivers there are those out there that still make our highways unsafe for all those drivers that are trying to do the right thing.I want to be the driver out there that can say. I have done everything to the best of my ability to make the highway safe for everyone even the one’s that decide they don’t have to drive safe.
your right something needs to be done but it seems the door way of blame swings one way only against truckers why is there nothing being done for regular automobiles that cut in front of loaded trucks then slam on the brakes and take the exit or driving on the phone now im not saying all truckers are perfect or inocent we all know that alot of drivers or better yet steering wheel holders have brought alot of this down on us as far as running legal ive honestly tried with arrow trucking and a few others to run legal begal yeh it can be done if you can pay your bills and live on 500 to 600 bucks a week before taxes if they would pay us enough to make a living decently alot of the drivers i know would stop when there supposed to but when i try to run legal dispatch gives me crap loads that dont pay anything and owner is a joke and as far as a strike your right its a pipe dream if it ever happens no problem the government will just make the illegal alliens legal and they will take our plance we all know there already here and taking freight for cheaper and hauling more weght with trucks that shouldnt be allowed in a dirt field much less on our highway and for the government that says its not safe for me as a trucker to driver after 10 or 11 hours a day is crap yeh that will make anyone tired but why is it safe for 4 wheelers to drive coast to coast if they desire and theres no laws stopping them or cops randomly checking there log book or wait or anything else they have free roam it seems they blame door needs to swing both ways there need to be more laws for regular no commercial vehicles more training before they get a license but as normal its only the truckers fault noone elses so it seems im trying to get rich i just wanna pay my bills and support my family that need it

EOBRecorders were about to come sooner or later, the Government wants a tighter control on you and all Industry in the United States. Problems for Truckers trying to make a decent living started with the Bush administration but was stalled, now these rules are being fast tracked by the Obama administration. Remember the current administration is much more anti business then the last. EOBRecorders might level the playing field eventually and raise rates because so many drivers will leave the industry. My advise is to start applying for local driving jobs now before these company’s are flooded with OTR drivers looking for work.
Having 10 years OTR behind me I can say for a fact that HOS rules were never complied with just due to the fact that you sit on a dock for many hours and then you have to meet a delivery
date and appointment time. Its just not possible.
Many weeks I used more than 90 hours of on duty time to get the job done.. Loose leaf logs were
the only thing to use. I was logging over 14000 miles a month.. And hell or high water you better not miss a delivery appointment..Dispatchers do not have clue. And then safety has your ass for logs not matching fuel receipts.. How can you win..

From what i can see they are wanting to impose european style safety regulations but keep american style pay. that dont work ,yes in western europe safety regulations are very strict but the freight rates are also regulated and the truckers are paid very well. here in america the freight rates are not regulated and the only way to make a respectable living is to run your ass off. you see here they are only wanting to regulate one end of it. that is because the american consumer wants to have their cake and eat it too. on one hand they dont want tired truckers on the road but on the other hand they want their cheap freight. i have lived in other areas of the world and yes i can tell you when it comes to what we pay for our stuff on the wally world shelf we are very spoiled consumers. right now i earn a very respectable middle class income however if the folks who want eobrs get their way then i would earn a poverty income. well im here to tell you im not going to live in a truck and spend time in this life that i will never get back away from my loved ones for a poverty income. i can easily stay home and live in poverty.
Regulations are killing this country. And the trucking industry is one of the best examples. Washington is out of control. These devices are one more way for the government to “regulate” how we make our living. How to “regulate” how we live our lives. I have been a driver since 1984. My safety record is stellar. So please don’t get me wrong. I am the biggest advocate for operating safely. But it’s gone way beyond that now. It’s time to start replacing these anti business politicians before it’s too late.

If the trucking industry does not bind together and shut down to cripple the economy, NOTHING, and I say NOTHING will change for our benefit. We are the only industry with a massive amount of power that will not bind together to make the change we need. We are viewed by the public as being big objects in the way, and by the government as being money making source for them. We should have formed our own Union long ago. We should be making decisions, and our panel of elected individuals should be up in the White House agreeing or disagreeing as to what is going on. And we should all be paying dues to “OUR” union. The dues can go for medical emergencies for our members, disasters, and for whatever else it is needed for to run “OUR” union. We watch as the airlines bind together, nurses make changes, auto workers make demands, etc.

It is so unfair to truckdrivers not to be able to stop the clock at your choice u have the right do so thats part of our freedom not been able to control that allow companies to put us on tight tight scedules where we cannot get rest or to do so it also is unhealthy becauce u have no time to eat healthy with the pressure of time rushing u every moment this has got to stop on board recorders would be no problem if we can stop the clock other than that expect many more deaths because we must be alert to dodge nontruck vehicles on the road
you guys and gals are right how is it possible that washington knows when to drive and when not to drive..i myself am a nighttime driver. load permitting..i seem to get more done in a day operating the hours i do. but not being able to stop the clock is a burden especially when you get near a town where rush hour is a bitch and it goes longer than a couple of hours as in most cities.. so naptime (2-3 hour nap) is a good choice to wait out the rush hour..but you cant since the non stoppable clock came into play.if the fmcsa and csa and others would see the whole picture beyond their desks and see where we are in this mattter and see it like we do, it would be great…(ha ha “see it like we do” ha ha) thats a good one huh??….they need to leave the rules like they are but just let us stop the clock when we see fit..after all we the driver are the only ones that know when we need a nap…we are the only ones who know when to stop when the weather isn’t safe or when we feel uncomfortable with the weather..it is unsafe when we have to go through weather that we feel unsafe just cause we cant stop the clock…i think all would agree that if we could stop when we need to without losing available time on the books that it would be more productive,safer,and the quality of life would be better…i know all of us dont agree with this idea… but its a start in the right direction…
Time for real changes. Time to give our government back to the people. These regulations are no different than banning cell phones, guns, and the freedom of choice. It’s time to take back what is ours, our freedom and our country.
My husband is an expedited driver. He doesn’t have to do the log books and all. His company will give him 24 hours to make a 20 hour delivery, and when you take out the time for fueling, there’s not much left. He takes every run he can, sleeps in the back of his van, and works his butt off to support his family. The government needs to stop with all this stuff. Being a truck driver/expedited driver is a hard job to do, especially with the clock always ticking down, dealing with increasing fuel prices, living in trucks..its a hard job. These people driving the country making all our lives better need more benefits and protections for them, not more headaches and out of pocket expenses. let these law makers run with a driver for a week or too, live how they have to live before deciding they know anything about it.
